At GrowBright, we understand that trust is the foundation of any partnership. This policy outlines how we protect your privacy and your data, and handle your personal and business information with care, respect and safety. Whether we are conducting a discovery assessment or delivering a solution, your data remains your own.

1. Our role and commitment

GrowBright operates as a Data Controller for your contact info and a Data Processor when we handle your business data during a project. We comply with the GDPR and the EU AI Act to ensure your data is handled with "Privacy by Design."

2. How we use your information

We only process your data when we have a legal reason to.

  • Contractual necessity: To deliver the AI strategies and training you hired us for.

  • Legitimate interest: To respond to your inquiries and improve our website.

  • Consent: When you explicitly opt-in to our newsletter or "AI Insights."

3. AI Transparency (EU AI Act Disclosure)

As an AI consultancy, we use generative and analytical AI tools to assist in our work.

  • Logic: AI tools are used to analyse business patterns and suggest workflow optimisations.

  • No automated decision-making: We do not use AI to make "final" decisions that have legal or significant effects on you (e.g., credit scoring or hiring).

  • Human oversight: Every AI-generated output is reviewed by a qualified human consultant at GrowBright before being shared with you.

4. Data security and third parties

We handle your information with a commitment to minimal retention and maximum security.

  • Retention: We only keep your data for as long as is necessary to fulfil our service obligations or as required by law.

  • Third parties: We never sell your data. We only share information with trusted service providers (such as scheduling or hosting platforms) required to run our business.

  • The "no-training" rule: We do not use your proprietary business data to train public AI models (like ChatGPT). We utilise enterprise-grade API connections that ensure your data remains private and is not "learned" by the system.

  • Encryption: All data transferred via our Wix-hosted site or professional tools is protected by SSL/TLS encryption.

5. Third party "sub-processors"

We use a small number of trusted tools to run our business. These include:

  • Wix.com (Website hosting and forms - US/EU)

  • Google Workspace (Email and document storage - US/EU)

  • OpenAI/Anthropic/Google (AI processing via API - US)

  • Note: We ensure all international transfers are protected by Standard Contractual Clauses (SCCs).

6. Cookies and tracking

We use cookies and similar tracking technologies to ensure our website functions correctly and to analyse how you interact with our content.

  • Essential cookies: These are necessary for website security and core functionality. They are always active.

  • Non-essential cookies: We only use analytical or marketing cookies (such as Google Analytics) if you provide explicit consent via our cookie banner.

7. Your rights and the Dutch AP

In addition to your rights to access and delete data, you have the right to request a human explanation of any AI-assisted analysis we provide.

  • Complaints: You have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

8. Protection of minors

Our services are strictly designed for professional use by business owners and their teams.

  • Age requirement: We do not knowingly collect or solicit personal data from anyone under the age of 18.

  • Verification: If we discover that we have inadvertently collected data from a minor, we will delete that information immediately.
